1. Acceptance of Terms

By accessing and using Flatery's property management platform ("Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you should not use the Service.

These terms apply to all users of the Service, including property owners, tenants, agents, and visitors.

2. Service Description

Flatery is a digital platform that facilitates property management, connecting property owners with tenants. Our services include:

• Property listing and discovery
• Tenant management tools
• Payment tracking and reminders
• Maintenance request management
• Analytics and reporting
• Communication tools

Important: Flatery is a technology platform. We do not own, sell, rent, or manage properties. We are not a party to any rental agreements between owners and tenants.

3. User Registration & Account

3.1 Registration Requirements:

• You must be at least 18 years old to create an account
• You must provide accurate, current, and complete information
• You must maintain and promptly update your account information
• You are responsible for maintaining the confidentiality of your password

3.2 Account Responsibilities:

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• One person or entity may maintain only one account
• Accounts are non-transferable

4. Owner Obligations

4.1 Property Listings:

• You must have legal authority to list and rent the property
• All property information must be accurate and not misleading
• Photos must accurately represent the property's current condition
• You must disclose all material defects and restrictions

4.2 Legal Compliance:

• Comply with all applicable local, state, and national laws
• Obtain necessary licenses and permits for rental operations
• Pay all applicable taxes on rental income
• Maintain adequate property insurance

5. Tenant Obligations

• Provide accurate personal and employment information
• Pay rent and other charges on time as agreed
• Maintain the property in good condition
• Comply with all terms of your rental agreement
• Respect the rights of property owners and neighbors
• Report maintenance issues promptly

6. Prohibited Activities

Users must not:

• Provide false, inaccurate, or misleading information
• Use the Service for any illegal purposes
• Infringe on intellectual property rights
• Post spam, malware, or harmful content
• Harass, abuse, or harm other users
• Circumvent the platform to avoid fees or obligations
• Create multiple accounts or impersonate others
• Scrape, copy, or misuse platform data
• Interfere with the Service's operation or security
• Discriminate against users based on protected characteristics

7. Payment Terms

7.1 Platform Fees:

• Flatery may charge service fees to owners and/or tenants
• Fee structure will be clearly communicated before transactions
• Fees are non-refundable except as required by law

7.2 Rent Payments:

• Payment processing is facilitated through third-party providers
• Flatery is not responsible for payment disputes between owners and tenants
• Users must resolve payment issues directly or through legal channels

8. Privacy & Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We collect and process personal data as described in our Privacy Policy
• We use industry-standard security measures to protect your data
• We do not sell personal information to third parties
• You have rights regarding your personal data (access, correction, deletion)

9. Intellectual Property

9.1 Platform Content:

• Flatery owns all rights to the platform, including design, code, and trademarks
• You may not copy, modify, or distribute our platform content
• The Flatery name and logo are protected trademarks

9.2 User Content:

• You retain ownership of content you upload (photos, descriptions, etc.)
• You grant Flatery a license to use, display, and distribute your content for Service purposes
• You represent that you have rights to all content you upload

10. Disclaimers & Limitations

10.1 Service "As Is":

• The Service is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free operation
• We do not verify all user information or property listings

10.2 No Liability:

• Flatery is not liable for disputes between owners and tenants
• We are not responsible for property condition or rental agreements
• We do not guarantee outcomes from using the Service
• We are not liable for any indirect, incidental, or consequential damages

10.3 Limitation of Liability:

To the maximum extent permitted by law, Flatery's total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Flatery, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your property listings or rental activities

12. Termination

12.1 By You:

• You may close your account at any time
• Some provisions of these Terms survive termination

12.2 By Flatery:

• We may suspend or terminate your account for violations of these Terms
• We may discontinue the Service with reasonable notice
• We may remove content that violates our policies

13. Dispute Resolution

13.1 User Disputes:

• Disputes between users (owners and tenants) must be resolved directly
• Flatery may provide mediation assistance but is not obligated to do so
• Legal disputes are subject to applicable laws and jurisdictions

13.2 Disputes with Flatery:

• Contact our support team first to attempt resolution
• Disputes shall be governed by the laws of India
• Jurisdiction shall be Bangalore, Karnataka

14. Changes to Terms

We may modify these Terms at any time. Changes will be effective upon posting to the platform. Significant changes will be communicated via email or platform notification. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. General Provisions

15.1 Entire Agreement: These Terms constitute the entire agreement between you and Flatery.

15.2 Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 No Waiver: Failure to enforce any provision does not constitute a waiver.

15.4 Assignment: You may not assign these Terms. We may assign them without restriction.

15.5 Force Majeure: We are not liable for delays due to circumstances beyond our reasonable control.
